Is an offer submitted through FiSBO legally binding?
A platform offer is part of the negotiation workflow; the parties need solicitor advice about when a binding agreement exists and what it contains.
Submitting an offer through FiSBO records a buyer's proposal. It should not be treated as a substitute for the formal sale and purchase agreement prepared or reviewed by the parties' solicitors.
Whether an agreement is binding depends on the facts, communications and applicable legal requirements. Do not rely on a general webpage to answer that question for a particular transaction.
Ask your solicitor before accepting, rejecting, changing or waiving terms. The seller should also involve their solicitor before committing to a contract.
